Selling a Property

Why Choose AFG Conveyancing When Selling Property?

When you’re selling, you need more than a template contract pulled together at the last minute. You need a thorough, legally precise set of documents that disclose what they should, protect your position and minimise the chances of a buyer walking away because something was missed. That’s where our focus on legal precision and compliance comes in.

We take the time to understand your property – not just what appears on the title, but renovations, permits (or lack of them), covenants, easements and any potential issues that must be disclosed. We’d rather have an honest conversation upfront than see your sale unravel later because a buyer discovers a surprise extension, owner-builder works or non-compliant structure that should have been mentioned. Our client-focused approach means we keep you informed in clear, straightforward language. We explain why we’re asking for particular information, how it affects your contract and what the risks are if something isn’t disclosed. If a client refuses to provide crucial information or insists on hiding something, we won’t act – because your integrity and ours both matter.

We also understand the practical realities of campaigns and auctions. Agents can’t start properly marketing – and you can’t accept offers – until your contract and vendor statement are ready. Our timely execution ensures your documents are prepared well before the first open, so you don’t miss opportunities or rush through critical details.

Our Conveyancer Process for Selling Property

1

Initial consultation & information gathering

We start by discussing your property, your plans (private sale or auction) and any renovations, extensions or works completed. We provide a clear explanation of what needs to be disclosed and why.

2

Title, property & compliance searches

We obtain title searches and relevant property certificates (Council, Water, Land Tax and Building Approvals) and check for covenants, easements, mortgages or caveats. We cross-check this with what you’ve told us to ensure everything lines up.

3

Contract & vendor statement preparation

Using the information gathered, we prepare a compliant contract of sale and vendor statement. We include fair, focused special conditions (not pages of unnecessary clauses) that reflect current law and protect your interests without scaring off buyers.

4

Support during your sales campaign

Once the property is on the market, we’re available to answer questions from you and the agent about contact terms, requested amendments and buyer enquiries. If a buyer’s conveyancer requests changes, we help you assess what’s reasonable and what’s not.

5

Pre-settlement adjustments & discharge arrangements

When the property is sold, we check the statement of adjustments for council rates,
water, land tax and owners’ corporation fees, making sure you’re not paying more than your share. We also coordinate with your lender to arrange discharge of any mortgage.

6

Electronic settlement & funds distribution

We prepare for and complete settlement through PEXA, ensuring all figures balance and funds are distributed to your nominated accounts. You’ll know exactly what is being paid where, and when your obligations end.

Ideally before you list with an agent. Your contract and vendor statement need to be ready early so serious buyers can review them and make offers without delay.

We’ll ask about renovations, extensions, owner-builder works, permits, approvals, easements, services and any issues you’re aware of. The more open you are, the stronger and safer your contract will be.

Non-disclosure can give a buyer the right to walk away or sue. If we know something must be disclosed and you refuse, we won’t act – because the risk to you is too high and it’s not consistent with our values.

No. Modern general conditions are much fairer than they used to be. We use a small number of targeted special conditions to protect you, instead of overwhelming buyers with unnecessary clauses.

Yes. We’ll work within auction deadlines to ensure your documentation is ready in time. We can also help respond to requests for contract amendments from potential buyers before auction day.

We check and agree the statement of adjustments to make sure council rates, water and other outgoings are apportioned fairly, and that you’re not left paying for a period after the buyer takes possession.

We liaise directly with your lender to arrange discharge, confirm payout figures and ensure they’re correctly entered into the PEXA workspace so the mortgage is removed from title at settlement.

We stay on top of timelines, communicate proactively and push for what’s required to keep your settlement on track. If delays arise on the other side, we’ll explain your options clearly and help you make informed decisions.
